1. Introduction
These Terms of Service ("Terms") are a legally binding agreement between you and Rumble Taxi ("Rumble Taxi", "we", "us", "our"). By creating an account, downloading our app, or otherwise using the Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, our Cookie Policy, and any other policies referenced herein.
If you do not agree, you must not access or use the Service. If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity.
2. Definitions
- "Service" means the Rumble Taxi ride-hailing platform, including the mobile and web applications, APIs, dispatch systems and ancillary services.
- "Rider" means any individual who requests a ride through the Service.
- "Driver" means any independent transport provider onboarded onto the Service to provide transportation services to Riders.
- "Trip" means a ride requested by a Rider and accepted by a Driver through the Service.
- "Content" means any text, images, ratings, reviews, comments or other materials submitted through the Service.
3. Eligibility and Accounts
To use the Service, you must (i) be at least 18 years old, or 13-17 with parental supervision and consent; (ii) have legal capacity to enter into binding contracts; and (iii) not be barred from using the Service under applicable law.
You agree to provide accurate, current and complete information when registering and to keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us at contact@rumbletaxi.com if you suspect unauthorised use.
We reserve the right to refuse, suspend or terminate your account if you breach these Terms or pose a risk to other users or to Rumble Taxi.
4. Use of the Service
Rumble Taxi provides a technology platform that connects Riders with Drivers. We are not a transportation carrier and do not directly provide transport services. Drivers are independent contractors.
You agree to use the Service only for lawful purposes and to:
- Comply with all applicable Tunisian and international laws.
- Provide accurate information and trip details.
- Respect Drivers, vehicles and other Riders, and refrain from harassment or violence.
- Not interfere with or disrupt the Service or its infrastructure.
- Not reverse-engineer or attempt to extract source code.
- Not use the Service to transport prohibited goods or substances.
5. Pricing and Payment
Fares are calculated based on a base fare, distance, time, surge multipliers, tolls and taxes. The estimate is shown before you confirm a Trip. The final fare may differ due to route changes, traffic, waiting time or additional services.
Payment is processed through the payment method on file or by cash where supported. By providing a payment method, you authorise us (or our payment partners) to charge applicable fees. You are responsible for costs from insufficient funds, expired cards or chargebacks.
Promotional codes and discounts are subject to specific terms (expiry, eligibility, single-use). We may modify or terminate any promotion without notice.
6. Cancellations and Refunds
You may cancel a Trip at any time before pickup. A cancellation fee may apply if you cancel after a Driver has accepted and started travelling toward you. Detailed rules, no-show policy and refund process are in our Refund and Cancellation Policy, which forms part of these Terms.
7. User Conduct
You agree not to use the Service to:
- Engage in unlawful, fraudulent, abusive or harmful behaviour.
- Impersonate any person or entity or misrepresent your affiliation.
- Upload viruses, malware or any malicious code.
- Submit false ratings, fake complaints or otherwise manipulate the rating systems.
- Collect personal data of other users without their consent.
- Use bots or scrapers to access or extract data.
Violations may result in suspension, termination, removal of Content and, where applicable, civil or criminal action.
8. Drivers
Drivers are independent contractors and not employees, agents or partners of Rumble Taxi. Specific terms governing Drivers, including eligibility, vehicle standards, conduct, earnings and insurance, are set out in our Driver Agreement. 9. Intellectual Property
The Service, including all software, designs, trademarks, logos, text and graphics (excluding User Content), is the exclusive property of Rumble Taxi or its licensors and is protected by Tunisian and international intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial purposes.
You retain ownership of Content you submit but grant us a worldwide, royalty-free, sub-licensable, transferable licence to use, host, store, reproduce, modify, adapt, publish, translate, distribute and display such Content for the purpose of operating, promoting and improving the Service.
10. Third-Party Content and Links
The Service may contain links to or display content from third parties. We do not endorse, control or assume responsibility for any third-party content, websites or services. Your dealings with third parties are solely between you and the third party.
11. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RUMBLE TAXI, ITS DIRECTORS, EMPLOYEES OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (I) THE AMOUNTS PAID BY YOU TO RUMBLE TAXI IN THE SIX MONTHS PRECEDING THE EVENT, OR (II) ONE HUNDRED TUNISIAN DINARS (TND 100). NOTHING IN THESE TERMS EXCLUDES LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, FRAUD OR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.
13. Indemnification
You agree to defend, indemnify and hold harmless Rumble Taxi, its affiliates and their respective officers, directors, employees and agents from any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising from (i) your use or misuse of the Service; (ii) your breach of these Terms; (iii) your violation of any law or third-party right; or (iv) any Content you submit.
14. Suspension and Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for breach of these Terms, suspected fraud, security risks or compliance with legal obligations. You may stop using the Service or close your account at any time by contacting us. Sections that by their nature should survive termination shall survive.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Tunisia, without regard to conflict-of-laws principles. Any dispute shall be submitted to the exclusive jurisdiction of the competent courts of Tunis, Tunisia. Before initiating litigation, the parties agree to attempt in good faith to resolve disputes through informal negotiation for at least thirty (30) days.
16. Changes to These Terms
We may modify these Terms from time to time. Material changes will be notified in advance via email or in-app notice and will take effect no earlier than fourteen (14) days after notification. Your continued use of the Service after the effective date constitutes acceptance. If you do not agree, stop using the Service.
17. Miscellaneous
- Entire agreement: these Terms with the Privacy Policy, Cookie Policy, Refund Policy and Driver Agreement constitute the entire agreement.
- Severability: if any provision is unenforceable, the remaining provisions remain in full force.
- No waiver: failure to enforce any right shall not be deemed a waiver.
- Assignment: you may not assign these Terms without our prior consent. We may assign them freely.
- Force majeure: we are not liable for any failure caused by events beyond our reasonable control.
- Notices: we may give notice via email, in-app message or website banner.
